Close ties
 

You must be living in Australia and have either spent at least 9 of your first 18 years in Australia as a permanent resident- you must have maintained close links with Australia; or you have at any time prior to 19/1/81 completed 3 months service in the Australian Armed Forces; or you have spent your formative years as a child in Australia; or you last entered Australia before 1 January 1975; or you arrived in Australia as a minor before September 1994, became unlawful before turning 18 and have spent most of your formative years in Australia.

You must be living in Australia and you are seeking to remain in Australia as a permanent resident and you come within one of the following categories:

  1. You are not the holder of a substantive visa or a Transit visa. You have made a valid visa application within 12 months after the day you last entered Australia unlawfully, or 12 months after your last substantive visa expired, and:
    • You spent at least nine out of your first 18 years in Australia and are under the age 45 at the time of lodging your application; or
    • You are a former member of the Australian Defence Forces, who either:
      • At any time prior to 19/1/81 completed 3 months service in the Australian Defence forces 9but nit as a member of the Reserve Defence Force or the Emergency Defence Force) of the Commonwealth; or
      • Undertook national service by virtue of a notice under section 26 of the National Service Act 1951 (national service provision) as in force at any time before 26 November 1964; or
      • Was discharged on medical grounds before completing three months continuous service. (Members of the armed forces of another country seconded to Australia are not eligible unless they had held permanent residence) or;
  2. You were unlawfully in Australia before turning18 and now aged 18 or over and still unlawfully in Australia, you did not enter on a Transit visa, you spent your formative years (generally, the greater part of your life between the ages of five and 18) in Australia and were either:
    • You initially entered Australia with your family and, through no fault of your own, remained unlawfully in Australia, but you¡¦re no longer living with that family; or you are holder of a substantive visa other than a Transit visa. Your last entered Australia before 1.1.1975, and have developed close personal ties with Australia.
    • In Australia before 1 September 1994 without a valid entry permit and, after being refused an entry permit in Australia, were not entitled to another one; or
    • You were refused a visa after 1 September 1994 and were not entitled to another one; or
  3. You spent your formative years in Australia, became unlawful in Australia before turning 18 and are now aged 18 or over and still unlawful in Australia. You initially entered Australia with your family and, through no fault of your own, remained unlawfully in Australia, but you are no longer a part of that family. You have not had a visa refused or cancelled under section 501 of the Act; or
  4. You are unlawfully in Australia, having entered before 1 January 1975, and have developed close personal ties with Australia. This group includes those who last entered Australia under visa-free arrangements then available to citizens of the United Kingdom and other Commonwealth countries.

 

Distinguished talent

.You must have an exceptional or outstanding record of achievement in your chosen field or profession, the arts or sport.
You must be nominated by an Australian organization, an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.

You must be nominated by an Australian citizen, an Australian permanent resident, an eligible New Zealand citizen or an Australian organization of a national reputation in the occupation, profession, or activity in which you have an outstanding talent.

Your nominator should complete form 1000 and include a brief resume of their own standing in that field.

In the occupation, profession or activity for which you are nominated, you must either:

  • Have an exceptional record of achievement in that occupation, profession or activity
  • Be able to demonstrate that you will be an asset to the Australian community; and
  • Have no difficult in obtaining employment or in becoming established independently in Australia.

Or you must have a record of outstanding achievement in the arts or sports, and still be prominent in that field.
Achievement in an occupation, profession or activity, at less than an international level would not generally be regarded as an exceptional or outstanding achievement.

Arts or sport. The applicant must:

  • Have a good record of outstanding achievement, and still be prominent in the arts or that sport.

You cannot apply in Australia if you have been issued with one of the following visas to enter Australia:

  • A visitor visa (Class TN or TR or TS)
  • A special category (Temporary) visa (Class TY)
  • A business (Short Stay) visa (Class UC)
  • A special purpose visa, or
  • An electronic authority issued by your travel agent or the international carrier.

Please note if the last substantive visa you held has expired, this application must be made within 28 days from the date of expiry of that visa.

 

Former resident

You must be a former Australian permanent residence living outside Australia and either have spent at least 9 of your first 18 years in Australia and wish to resettle in Australia; or you have at any time prior to 19/1/1981 completed 3 months service in the Australian Armed Forces.

You must be living outside Australia and either:

  1. Be a former Australian permanent resident who has spent at least 9 of your first 18 years in Australia and wish to resettle in Australia. You must have maintained business, cultural or personal ties with Australia and be under the age of 45 at time of lodging your application, or
  2. Have
    • At any time prior to 19/1/81 completed 3 months service in the Australian Defence Forces (but not as a member of the Reserve Defence Force or the Emergency Defence Force) of the Commonwealth; or
    • Undertaken national service by virtue of a notice under section 26 of the National Service Act 1951 (national service provision) as in force at any time before 26 November 1964; or
    • Been discharged from such service as being medically unfit by reason of such service before completing 3 months service.

Members of the armed forces of another country seconded to Australia are not eligible unless they held permanent residence)
